Probate is the court-supervised administration of a decedent’s estate. When an individual passes away, the personal representative handles the transition of their assets and pays any debts and taxes. The Executor is the personal representative named in a Last Will and Testament. If the decedent did not have a Last Will, the Iowa Code determines who the personal representative will be.
If the decedent had a revocable Trust, it is possible to avoid probate entirely.
Probate also refers to guardianships and conservatorships. An individual who is a minor or who is incapacitated may need to have a court-supervised relationship established so that another person can assist with medical and financial needs.
